Privacy policy – We care about your privacy
As of May 25, 2018, the new Regulation on the Protection of Personal Data (RODO) applies throughout the European Union. In this document, we describe the services we provide and explain how we protect your privacy. We also write how you can exercise your rights over the data we have collected.

The entity determines why and how it processes your data.
It does so on the basis of Article 26, paragraph 1 of the RODO: Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC – the General Data Protection Regulation.
II. General principles of personal data processing
Where do we store your data?
We store your personal data in the European Economic Area (EEA). They may also be transferred outside this area and processed there. Whenever we transfer data, we do so in accordance with applicable law. If we transfer data outside the EEA, we use the Standard Contractual Clauses and Privacy Shield to secure that data outside the EEA.
Who has access to your data?
Only entities that manage your data have access to it.
This means that we never transfer your data for marketing purposes, sell it or use it to exchange data with other third parties.
We transfer your data to selected third parties – when we perform the services we have defined, and only to the extent that we can entrust their processing under the contracts we have signed. Details of these third parties can be found below.
What are the legal bases for data processing?
We process your personal data under a contract. You will find a model of it in the terms and conditions of our website or the terms and conditions of promotions, contests, sweepstakes, etc. that we organize for you. We process your data only to the extent that is necessary to properly perform the service we provide to you.

III. Your rights in the context of RODO
Right of access to data
At any time you have the right to check which of your personal data we store. To do so, you can write to us at gdpr@napiteldiamond.pl
We will provide you with this information in an email.
Right to data portability
When we process your personal data by automated means based on your consent or a contract with you, you have the right to receive a copy of your data in a structured, commonly used and readable format. We may send this copy to you or to another entity that will henceforth process the data. Please note that this only applies to personal data we have from you.
The right to correct data
You have the right to correct or complete your personal information. If you have an account in the www.napiteldiamond.pl store under the settings of this account, you can edit both your personal information and consents at any time.
Right to erasure
You have the right to delete your personal data that we process at any time. Exceptions are when:
- you have an open order – not yet shipped or only partially shipped;
- We look forward to receiving your payment, regardless of payment method;
- we suspect or are certain that you have used our services inappropriately in the past four years;
- You have been denied credit in the past three months;
- you bought something from our store – then we will keep your personal information about the transaction for accounting purposes.
The right to object to the processing of data on the basis of legitimate interest
You also have the right to object to the processing of your data to the extent that we do so, where we and others managing your data have a legitimate interest. We will then stop processing your personal data. We will not do so when legally your interest or your rights are overruled or there are legal claims against you. In such a situation, we will inform you.
Right not to consent to direct marketing
You have the right not to consent to receiving direct marketing materials by e-mail, including the analysis of your profile that we do to create such materials.
To opt out of receiving direct marketing materials, simply:
- you will follow the instructions contained in any such e-mail;
- you will inform us by email or phone.
The right to restrict the processing of personal data
You have the right to request that we restrict the processing of your personal data when:
- you do not consent to us processing your data based on the legitimate interests of the entities that jointly manage your data. We will limit the processing of your data after we have verified whether such a legitimate interest exists;
- you report that your personal data is incorrect. We will limit the processing of your data until we have verified its correctness;
- The processing of your data is unlawful. Then you may not agree to the deletion of your personal data and instead request a restriction on the use of your personal data;
- we no longer need your personal information, but it is required to report or dismiss a claim.
The right to lodge a complaint with the supervisory authority
If you believe that we are processing your personal data inappropriately, please contact us. You also have the right to file a complaint with the supervisory authority.

IV. Use of data in the purchasing process
Why do we use your personal information?
We use your personal information to manage purchases made online from stores:

We need this data to process your orders and returns, to send you notifications about the delivery status of products, and to resolve any related issues. We also use your personal data when we manage your payments and process complaints and warranty claims regarding the products you ordered.
With personal data, we get the information necessary to finalize the purchasing process.
Based on them, we can:
- identify you and verify that your age qualifies you for online shopping;
- Confirm your address with external entities;
- check your payment history and creditworthiness to offer you various forms of payment.

Who has access to your personal information?

- warehouses and courier companies that deliver orders;
- companies that process payments;
- Banks that check your identity and creditworthiness – when you buy on installments;
- debt collection companies.
For what purpose do we process your personal data?
We process your data to provide you with services and deliver your orders.
How long do we keep your data?
We will keep your data for as long as you are our active customer.
How does the automated decision-making process work?
If you apply for an installment purchase as a payment method, the banks will process it automatically. In this situation, they are the controllers of your data. You have the right to refer to their decision, such as questioning it, and report it to our employee.
V. Use of data in marketing
Why do we use your personal information?
We use your personal information to provide you with information and marketing offers:
- E-mail;
- SMS;
- By phone;
- via PUSH messages;
- By traditional mail.
What personal data do we process?
We process the following personal data:
- Contact information: e-mail address, telephone number and postal code;
- demographics;
- information about the offers you use and the products you place in or remove from your shopping cart.
If you have an account with our stores, we will also process your personal data provided to us in connection with that account, among other things:
- name;
- address;
- demographics;
- purchase history;
- The way you navigate the site and the items you click on.
Who has access to your personal information?
We transfer your personal data to third parties only to provide you with information and marketing offers. With this data, marketing agencies – with whom we have signed separate data processing entrustment agreements – can fulfill our marketing objectives to the extent that we have assigned them.

We process your personal data based on your consent to receive marketing information. We send this type of information to you when we have a legitimate interest in doing so. The exceptions are materials we send by traditional mail, such as catalogs.

You have the right to withdraw your consent to process your personal data and receive marketing information at any time. Once you do so, we will immediately stop processing your data for marketing purposes and sending you any marketing offers.
To opt out of receiving marketing information, simply:
- you will follow the instructions contained in each marketing message we provide to you,
- You edit your account settings in the settings tab of our store.
How long do we keep your data?
We will keep your data for direct marketing purposes until you withdraw your consent. We will continue to send you commercial information by e-mail until we consider you to be an inactive customer. We will do this if you do not open any e-mail from us within three years. We will then remove your personal information from our database.

What are cookies?
Cookies are computer data, especially small text files, saved and stored on the devices through which you use our services.
Administrator cookies are our cookies that are associated with the provision of electronic services by us through our websites.
External cookies are cookies of our partners, which are associated with their use of the website of our service.
How do we use cookies?
